Thank you (“You”) for using the Kocomojo web application (the “Web Application”), SDK and API services and other software (collectively, “Products”) provided through the “License Agreement” (as defined below), visiting the Kocomojo site, (“Site”) and/or downloading the Kocomojo mobile application (“App,” and together with the Site and the Products, the “Service”) owned and operated by Kocomojo, LLC (“Company,” “we” or “us”). We are committed to treating Your personal information with respect and sensitivity. Our privacy commitment is described in this Privacy Policy. As our services evolve and we perceive the need or desirability of using information collected in other ways, we may modify this Privacy Policy from time to time, in which event we will provide notice of such modifications to You. In order to continue using the Service following any modifications to the Privacy Policy of which we notify You, You must agree to be bound by such modifications.  We post the effective date of our Privacy Policy on the Site. We also encourage You to check our Site and/or App frequently to see the current Privacy Policy  in effect and any changes that may have been made to it. If we make changes to this Privacy Policy we will post the revised Privacy Policy and the revised effective date on the Site and within the App in addition to providing notice to You.

Your Rights

We may disclose Your “PII” (as defined below) to our customers in order to deliver content and promotions to You through the Service.   We do not currently disclose Your PII to affiliates or other third parties for their use in marketing their products and services to You or for other purposes.

General Information

We believe that You have the right to understand how Your information is stored and used. We require that sites linked to our Service contain a notice identifying their privacy policies. We are not responsible for the privacy practices of any third parties or the content of linked sites although we do encourage You to read the applicable privacy policies and terms and conditions of such parties or websites.

Information We Collect

In general, You can visit the Site or use the App or Web Application without telling us who You are or revealing any information about Yourself. If You wish to obtain information about the Products or the Service, You can contact us. We may collect personally identifiable information, including Your name, company name, e-mail address, street address, geolocation, mobile device identifier, user name, gender, billing information (including credit card number, card expiration date and security code), images, videos, user-generated templates, beacon identifiers and Site and App usage information (“PII”). By accessing the Service, You are providing Your PII to us, and You explicitly agree to our collection and use of such information as described in this Privacy Policy.  We may use Your PII to offer our own and our affiliates’ and third party customers’ products, services and promotions through the Service, but only we, our affiliates, our customers and any “Service Providers” (as defined below) involved in distributing the offers or providing the products, services and/or promotions will have access to Your PII, and any such affiliates and third parties are required to use any PII we provide them only for those intended purposes.


In addition, our web servers may collect Your domain names or IP addresses. This information may be aggregated to measure the number of visits, average time spent on the site, pages viewed, usage and engagement information, etc. We may use this information for internal research purposes, to measure the use of our Service, to provide reports and analytics to our customers regarding usage and performance of the Service and to improve the content we offer. We may share with third parties this aggregated experiential information or other data which does not personally identify visitors to our site. This information helps us develop a better Service that is more useful and accessible to You.


We may sometimes use other businesses (“Service Providers”) to perform certain services for us, such as maintaining the Service and processing inquiries or transactions conducted through the Service.  We provide our Service Providers with the information reasonably necessary for them to perform these services on our behalf.  Each Service Provider must agree to implement and maintain reasonable security procedures and practices appropriate to the nature of the information involved in order to protect Your PII from unauthorized access, destruction, use, modification or disclosure.

Protecting Children’s Privacy

This Service is not designed nor intended to be attractive to use by children under the age of eighteen (18). We do not knowingly collect PII from such minors. If You are under the age of eighteen (18), please do not submit any information to us.  If we become aware that we have inadvertently received PII from a user under the age of eighteen (18), we will delete such information from our records.  Because we do not knowingly collect any PII from children under the age of eighteen (18), we also do not knowingly distribute such information to third parties.


We may use cookies and other similar technologies to personalize our Service for You, including, without limitation, to store Your authentication token when You are logged into components of the Service, and do not currently, but may in the future, use cookies and other similar technologies to collect aggregate information about Service usage by all of our users. A cookie is a text file that our Service may transfer to Your computer’s or mobile device’s hard drive for record-keeping purposes and to enhance the quality of Your use of the Site or App, respectively. A cookie assigns a random, unique number to Your computer or mobile device. Cookies cannot be used to run programs or deliver viruses to Your computer or mobile device. You can set a web browser to refuse cookies, but doing so will limit system performance and may even cause certain features of the Site to malfunction or not to work at all.

Disclosure of Information

The use of Your information is subject to the Privacy Policy and Terms (and the License Agreement, if applicable to You) in effect at the time of use. The provisions contained herein supersede all previous notices or statements regarding our privacy practices with respect to this Service.


We may disclose Your PII to unaffiliated third parties if: (1) You request or authorize it; (2) the information is provided to help complete a transaction for You; (3) the information is provided to comply with laws, applicable regulations, court orders or subpoenas, to protect or exercise our legal rights or defend against legal claims, to enforce our Terms, License Agreement or other agreements, or to protect our rights, property or safety or the rights, property or safety of our users or others (e.g., to a consumer reporting agency for fraud protection, in order to investigate, prevent or take action regarding illegal activities, copyright violations, trademark violations or other violations of the personal or intellectual property rights of others, etc.); (4) the disclosure is done as part of a purchase, transfer or sale of services or assets (e.g., in the event that substantially all of our assets are acquired by another party, customer information may be one of the transferred assets); (5) the information is provided to our agents, outside vendors or service providers to perform functions on our behalf (e.g., analyzing data, providing marketing assistance, providing customer service, etc.); or (6) the information is provided to others as described in this Privacy Policy.

Communications, Opt-Out, Access and Security

We may use Your e-mail address or otherwise contact You through the dashboard, direct messages or otherwise via the Service or contact information you have provided to us to respond to Your inquiries or to provide information on the Site, App, Products or Service to You. If You do not wish to receive e-mails, offers or other notices from us in the future, You can “opt out” by contacting us at the address indicated at the end of this Privacy Policy or by following the instructions in any e-mail to unsubscribe. In addition, if You provide us with PII, You will always have the option of requesting that the PII be removed from our Service and to opt out of having Your PII collected, stored, used and/or shared as contemplated in this Privacy Policy by contacting us at the address indicated at the end of this Privacy Policy. To review Your PII, make any changes or corrections or to request that we remove Your PII from the Service, please contact us at the address listed below. We will try to complete Your request as promptly as possible. Any changes will affect only future uses of Your PII.


We use reasonable security measures in our physical facilities and in our computer systems, databases and communications networks that are designed to protect information contained within our systems from unauthorized access, loss, misuse, disclosure or alteration.  We also require our Service Providers to implement and maintain reasonable security procedures and practices appropriate to the nature of the information we share with them.  No data transmission over the Internet or any wireless network can be guaranteed to be 100% secure.  As a result, while we strive to protect PII, we cannot and do not guarantee or warrant the security of any information You transmit to or from the Service, and You do so at Your own risk.


We are not responsible for maintaining the confidentiality of any non-public information that You provide us. If there is information that You wish to protect from disclosure to others, do not provide it to us.

Data Processing in the United State

The Service is intended for use within the United States, and we do not represent or warrant that the Service, or any part of it, is appropriate or available for use in any other jurisdiction.  You access the Service on Your own initiative and at Your own risk, and are responsible for complying with all local laws, rules and regulations.  We may limit the availability of the Service, in whole or in part, to any person, geographic area or jurisdiction we choose, at any time and in our sole discretion.  Please be aware that Your PII and communications may be transferred to and maintained on servers or databases located outside Your state, province or country.  If You are located outside of the United States, please be advised that we process and store all information in the United States.  The laws in the United States may not be as protective of Your privacy as those in Your location.  By using the Service, You agree that the collection, use, transfer and disclosure of Your PII and communications will be governed by the applicable laws in the United States.
